Terms of Service

1. Acceptance of terms

By accessing or using TrueDial's services (the "Services"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization.

2. The Services

TrueDial provides an AI-powered customer-intake system designed for phone-driven service businesses. Services include: AI voice agent provisioning, CRM (GoHighLevel) sub-account configuration, knowledge-base build, multi-tech routing configuration, EMERGENCY MODE protocol, F-Matrix call grading, weekly call reviews, and ongoing maintenance.

3. Billing

Setup fees ($2,997–$5,997 standard, $5,000+ Enterprise) are billed at signup and non-refundable except under the 90-day Phone Profit Guarantee. Monthly subscription fees are billed at the start of each billing cycle. Included minutes are documented per tier; overage rates are documented per tier and billed monthly. Annual prepay discount of 10% available on Growth / Pro tiers.

4. Phone Profit Guarantee

If, within the first 90 days following go-live, your phone-channel revenue (measured via CRM call + opportunity data) has not increased compared to the 30-day baseline captured at onboarding, you are entitled to a full refund of setup fee and all subscription fees paid through that date, on written request to alex@truedialco.com. No clawbacks, no fine print.

5. Your data

You own the data in your GoHighLevel sub-account, including all contacts, call recordings, transcripts, and CRM records. We process this data on your behalf to provide the Services and to grade calls against the F-Matrix. You may export or port your data at any time. On cancellation, we will keep your sub-account active for 30 days to allow for porting.

6. Cancellation

You may cancel month-to-month subscriptions at any time with 30 days written notice. Annual prepaid subscriptions are non-refundable unless under the Phone Profit Guarantee. Phone number portability supported within 5-10 business days following cancellation.

7. Compliance — TCPA, A2P 10DLC, DNC

You are responsible for ensuring all outbound communications initiated through the Services comply with the Telephone Consumer Protection Act (TCPA), Do-Not-Call (DNC) registry, and CTIA A2P 10DLC carrier requirements. We provide infrastructure compliant with these regulations but cannot enforce your specific use cases. You agree to indemnify us from liability arising from your use of the Services in violation of these regulations.

8. Limitations of liability

To the maximum extent permitted by law, TrueDial Company LLC, its officers, members, and affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or business arising from or related to your use of the Services. Total cumulative liability is capped at the fees paid by you in the 12 months preceding the claim.

9. Governing law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Pine County, Minnesota.

10. Changes

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
